How to register a tenancy agreement online: preliminary information
Before asking yourself how to register a rental contract online, it is good to keep in mind some information about the necessary procedure. First of all, the first form to fill out is the Registrazione Locazioni Immobili (RLI), which can be entered online through RLI Web, the dedicated platform accessed through the Fisconline portal.
However, before registering a rental contract online, you need to be in possession of all the necessary documents, starting with the rental contract signed by both parties (with the possible option of the cedolare secca). You will also need the energy performance certificate (APE) and, of course, the identity documents of the landlord and the tenant in order to register the contract.
You should also be aware of the type of information you will be requested to fill out in this form. The completion of this form will involve filling out various sections concerning the type of contract and property, taxation and any "facilitated" taxation systems, the persons involved and the clauses for differentiated annual fees.
How to access Fisconline services to register a rental contract
If you do not know how to register a rental agreement online, it is advisable to rely on qualified people to help you fill in the forms, as even the slightest mistake could lead to costly consequences.
Lease or rental contracts can be registered online using the telematic services of the Revenue Agency (this is compulsory for estate agents and owners of at least 10 properties).
You have to access the reserved area of the Revenue Agency with your SPID credentials, your electronic identity card (CIE), or your Fisconline pin. On the first page "My desk" select "Services for" - "Registering rental contracts" and follow the instructions for "First registration" or "Subsequent fulfilments".
Registering the rental contract online via RLI
The RLI website allows you to register your rental contract online, without installing any software. You can also register lease agreements, communicate extensions, transfers, and terminations, and exercise or revoke the option for the cedolare secca via this website.
To register a rental contract online with RLI web, you must attach a copy of the contract in TIF, TFF or PDF/A format. It is not compulsory to attach a copy of the contract if these characteristics are present:
- residential tenancy;
- the contract is stipulated between natural persons not acting in the exercise of a business, art or profession;
- a number of landlords and tenants, respectively, not exceeding three;
- a single housing unit and a number of appliances not exceeding three;
- all the properties are registered with an annuity;
- the contract contains only the discipline of the rental relationship and, therefore, does not include further agreements.
However, when filling in the special cases box, it is always necessary to attach the contract.
In order to register a rental contract online, the landlord (in most cases, or the tenant more rarely), must access the reserved area of Entratel/Fisconline. Once in the main screen, click on "Services for" and then on "Register rental contracts".
Then the screen will appear where you can fill in the RLI form for the first registration of the contract or, if necessary, for subsequent registrations. Before sending the rental contract electronically, you must first enter the tax code of the person requesting the registration and the identification of the contract you wish to create without spaces and then click on "continue".
The next step is to select (from the drop-down menu that opens) the type of contract and the competent territorial office of the Revenue Agency. In order to complete the process, you will need to provide information related to the following:
- the landlord (owner of the property)
- the tenant;
- the cadastral information of the property;
- any option for a flat-rate tax;
- the start and end dates of the contract;
- the annual rent.
Taxes and stamp duties are paid by debiting the indicated Iban code. Finally, it will be possible to insert any documents to validate the registration in the "Attachments" box. Click "Enter" and then "Continue" to complete the operation. It is advisable to carefully check the information entered before giving the final confirmation because, once the operation is complete, it will no longer be possible to modify the data.
